General Terms and Conditions (GTC)
1 Scope of application
These General Terms and Conditions ("GTC") apply to the business operations of Chauffeur Grischun GmbH (hereinafter referred to as "CG").
CG operates the website www.chauffeur-grischun.ch, where online bookings for paid services related to upscale passenger transportation and, in exceptional cases, sensitive and/or valuable goods transportation can be made.
Furthermore, an online shop is operated on this website where gift vouchers, package trips, as well as fan merchandise such as umbrellas, caps, shopping bags, pocket knives, etc., are sold.
These GTC apply to the aforementioned areas as well as to the other services provided directly and indirectly by CG to the customer.
2 Conclusion of contract
The contract is concluded by the binding booking of the desired service or the completion of the purchase for a product from the online shop.
Furthermore, a contract is concluded when a customer definitively accepts an offered service (via email or telephone).
3 Pricing
Subject to other offers, all prices are quoted in Swiss Francs (CHF). All prices are exclusive of value-added tax and any other applicable taxes.
CG reserves the right to change prices at any time. The prices valid at the time of contract conclusion on the website www.chauffeur-grischun.ch or in any brochures expressly valid for this period shall apply.
4 Payment
Half of the invoiced amount for services is due at the time of conclusion of a contract and will be charged directly upon booking using credit card, PayPal, Twint, or other payment methods.
The remaining half is due at the start of the service and can be settled with the chauffeur via credit card, cash, or TWINT. The customer is obligated to pay this amount before utilizing the service, provided they haven't already paid the full amount during the ordering process via credit card, PayPal, or other payment systems.
For orders from the online shop, www.chauffeur-grischun.ch For purchases from the online shop, the entire amount is due at the time of purchase. The ordered goods will be shipped within a few days after receipt of payment.
5 Obligations of the company
5.1 Provision of services
Subject to any differing agreement, the company fulfills its obligations by providing the agreed-upon service. The service includes the services that were published online at the time of contract conclusion or were available.
For services as well as sales on www.chauffeur-grischun.ch, the registered office of CG is considered the place of performance, unless otherwise stipulated.
5.2 Auxiliary persons
The parties expressly have the right to engage assistants to fulfill their contractual obligations. They must ensure that the engagement of assistants complies with all mandatory legal provisions and any collective labor agreements.
6 Customer's Obligations
6.1 Exercise of the rights of use
By accepting these GTC, the customer confirms that they have unrestricted legal capacity and are of legal age. The customer expressly declares upon registration that all information provided is truthful and up to date.
6.2 Obligations to Cooperate
The customer is obliged to make all necessary arrangements required for the provision of the service by CG. If the customer cannot arrive punctually at the agreed pick-up location, they must immediately notify CG by telephone so that the chauffeur can be informed promptly. The chauffeur will wait for the customer for fifteen minutes without charge if no such notification is received. If no notification is received from the customer by this time, the journey is considered to have been completed, and the outstanding amount not paid in the deposit is owed.
If a customer is unable to avail the service as planned, a solution can be sought with CG. Rescheduling is possible if CG has available capacity at the new time. However, CG is not obligated to accept a rescheduling.
If a customer fails to avail the booked service and does not provide any notification, the service is considered fulfilled after a fifteen-minute waiting period. The invoiced amount is therefore due in full and must be settled within a period of 5 days.
7 Cancellation
7.1 Services
A cancellation of a booking is possible in written form (via email) or by phone (with confirmation email from CG) without cost consequences - meaning refund of the deposit - up to 21 days before the scheduled service. After this period, from 21 days up to 5 days before the service, a deposit of 50% of the invoice amount will be retained. In case of cancellation from 5 days up to 24 hours before the service, only 25% of the remaining invoice amount (i.e., 75% of the total amount) is payable. If a customer fails to appear for the service without prior notice, the entire invoice amount is owed and must be settled within 5 days from the service date.
7.2 Products
Exchange of products is generally excluded.
8 Insurance
The passenger is insured by CG's insurance in the event of accidents while in the vehicle and during the journey. However, as is customary in Switzerland, the passenger is responsible for ensuring adequate personal insurance. CG assumes that the customer has the standard personal insurance (accident insurance) customary in Switzerland, even if the customer is not a resident of Switzerland. The customer cannot make any further claims beyond what is agreed upon in the standard passenger insurance.
9 Liability
9.1 Damages
Liability for any indirect damages and consequential damages is fully excluded. Specifically, any liability arising from arriving at the destination too late, such as missing a connecting transportation service, is expressly excluded.
9.2 Forgotten and lost items
CG accepts no liability for forgotten or lost items. If a passenger leaves something in the vehicle, it will be brought to the company's premises and kept there.
9.3 Auxiliary persons
Any liability for auxiliary persons is fully excluded.
10 Data Protection
CG may process and use the data collected during the conclusion of the contract to fulfill its obligations under the contract. CG takes the necessary measures to secure the data in accordance with legal regulations. The customer fully agrees to the storage and contract-compliant use of their data by CG and is aware that CG is authorized and obligated to disclose information to the customer or third parties upon order from courts or authorities.
Furthermore, the privacy policy applies.
11 Changes / Amendments
These General Terms and Conditions can be amended by CG at any time.
The new version becomes effective upon publication on the CG website.
For customers, the version of the GTC that is in effect at the time of contract conclusion generally applies, unless the customer has agreed to a newer version of the GTC.
12 Priority
These GTC supersede all previous provisions and contracts. Only provisions from individual contracts that further specify the provisions of these GTC take precedence over these GTC.
13 Severability Clause
Should any provision of this contract or an attachment to this contract be or become invalid, this shall not affect the validity of the remaining provisions of the contract. The parties to the contract shall replace the invalid provision with a valid provision that comes as close as possible to achieving the intended economic purpose of the invalid provision. The same applies to any contractual gaps.
14 Confidentiality
Both parties as well as their auxiliary persons undertake to treat all information related to the services provided or acquired confidentially. This obligation remains in effect even after termination of the contract.
15 Force Majeure
If timely performance by CG, its suppliers, or third parties engaged is rendered impossible due to force majeure such as natural disasters, earthquakes, volcanic eruptions, avalanches, severe weather, thunderstorms, storms, pandemics, wars, unrest, civil wars, revolutions, and uprisings, terrorism, sabotage, strikes, nuclear accidents, or reactor damage, etc., CG is exempted from fulfilling the affected obligations for the duration of the force majeure and a reasonable period thereafter. If the force majeure lasts longer than 30 days, CG may withdraw from the contract. In this case, CG must fully refund any consideration already provided by the customer.
Any further claims, especially claims for damages resulting from force majeure, are excluded.
16 Applicable Law / Jurisdiction
These GTC are subject to Swiss law. Unless mandatory legal provisions take precedence, the court at the registered office of CG shall have jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods (SR 0.221.221.1) is explicitly excluded.
